1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of BD Pigeon Hub (the "Platform"), including the website at bdpigeonhub.com and the BD Pigeon Hub mobile application (iOS and Android), operated by AlphaCue Technologies ("we", "us", or "our").

By registering an account, browsing the Platform, or using any feature, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

• You must be at least 13 years of age to use BD Pigeon Hub.
• Users aged 13–17 must have the consent of a parent or legal guardian.
• To list pigeons for sale, place bids, or conduct financial transactions, you must be at least 18 years of age.
• You must be a human user. Automated accounts or bots are not permitted unless explicitly authorised by AlphaCue Technologies in writing.
• If you are registering on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. User Accounts

3.1 Registration

You must provide accurate, current, and complete information when registering. Impersonating another person or creating a misleading identity is not permitted.

3.2 Account Security

You are responsible for keeping your password confidential and for all activity that occurs under your account. If you suspect unauthorised access, notify us immediately at alphacuetechnologies@gmail.com.

3.3 One Account Per Person

Each person may hold only one active account. Creating multiple accounts to circumvent restrictions, manipulate listings, or inflate engagement is prohibited.

3.4 Account Verification

We may offer a "Verified" badge to sellers who meet certain criteria. Verification is a discretionary indication of good standing — it does not constitute an endorsement of the user or their listings.

4. Marketplace Rules

4.1 Seller Responsibilities

By listing a pigeon for sale, you represent and warrant that:

• The pigeon described in the listing is real, is in your possession or custody, and is accurately described.
• All photos uploaded are genuine, unaltered images of the actual pigeon being sold (or minimally processed for brightness/contrast only).
• The listed price, ring number, breed, age, and health condition are truthful.
• You have the legal right to sell the pigeon.
• You will complete the sale if a buyer makes an offer you accept.

4.2 Buyer Responsibilities

• Buyers are responsible for independently verifying the pigeon's condition, ring number, breed, and health before completing a purchase.
• BD Pigeon Hub does not guarantee the accuracy of any listing and is not a party to any transaction.

4.3 Listing Content

• Listings must be for living pigeons only. Listing deceased pigeons, pigeon eggs without prior agreement, or unrelated items is not permitted.
• All listing text and images must be in the Bangla or English language.
• Duplicate listings for the same pigeon are not allowed.

5. Auction Rules

• Binding bids: All bids placed in an auction are legally binding. By placing a bid, you commit to completing the purchase at that price if you win.
• Auction cancellation: Sellers may not cancel an auction once it has received one or more bids without contacting us and providing a valid reason.
• Anti-snipe protection: Bids placed in the final minutes of an auction may automatically extend the auction end time. This is a platform feature — the extended end time is final.
• Reserve price: If a reserve price is set and not met at auction end, no sale is completed and neither party is obligated.
• Winner obligation: The auction winner is obligated to complete payment within 48 hours of auction end. Failure to do so constitutes a breach of these Terms.
• Seller obligation: If the reserve is met and the auction ends with a winner, the seller must transfer the pigeon to the winner.

6. Payments & Transactions

• All transactions on BD Pigeon Hub are conducted in Bangladeshi Taka (BDT).
• Payments are made peer-to-peer using services such as bKash, Nagad, or Rocket. BD Pigeon Hub has no involvement in these transactions.
• Buyers submit a transaction ID (TXN ID) to the platform as a record of payment. This does not constitute confirmation of receipt by the seller — the seller must independently verify the payment in their own mobile banking account.
• BD Pigeon Hub is not responsible for failed, fraudulent, or disputed payments. Disputes must be resolved directly between the parties.
• We reserve the right to suspend accounts involved in confirmed payment fraud.

7. User Content

7.1 Your Content

You retain ownership of the content you post (photos, text, pigeon data). By posting content on BD Pigeon Hub, you grant AlphaCue Technologies a non-exclusive, royalty-free, worldwide licence to display, store, and distribute that content solely for the purpose of operating and promoting the Platform.

7.2 Content Standards

All content you post must:

• Be related to pigeons, the pigeon hobby, or platform features.
• Be truthful and not misleading.
• Not infringe the intellectual property rights of any third party.
• Not contain offensive, hateful, sexually explicit, or illegal material.

7.3 Image Authenticity

Our system automatically analyses uploaded images for signs of digital editing and displays an edit score alongside photos. This is intended to promote honest listings and is not a definitive forensic finding. Intentionally uploading heavily manipulated images to misrepresent a pigeon is a violation of these Terms.

8. Prohibited Conduct

You must not:

• Create fake or misleading listings, profiles, or pigeon records.
• Manipulate prices or bids through collusion or shill bidding.
• Use the platform to conduct any activity that is illegal under the laws of Bangladesh.
• Harass, threaten, or abuse other users via messages, posts, or comments.
• Attempt to scrape, reverse-engineer, or otherwise extract data from the Platform in bulk without written permission.
• Use automated tools (bots, scripts) to interact with the Platform without authorisation.
• Attempt to bypass security features, including reCAPTCHA, authentication, or access controls.
• Share, sell, or transfer your account to another person.
• Post spam or repetitive content on the community wall.
• Upload content that contains viruses, malware, or harmful code.

9. Intellectual Property

All Platform software, design, logos, branding, and non-user content are the intellectual property of AlphaCue Technologies and are protected by applicable copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from Platform content without our prior written consent.

10. Account Suspension & Termination

We reserve the right to suspend or permanently terminate any account, at our sole discretion, for:

• Violation of these Terms or our Privacy Policy.
• Fraudulent activity or misrepresentation.
• Behaviour harmful to other users or the Platform.
• Requests from law enforcement or legal authorities.

You may delete your own account at any time via the account settings or by submitting a request at bdpigeonhub.com/legal/delete-account/. Upon termination, your public listings and posts will be removed. Your messages with other users may be retained for those users' records.

11. Disclaimers

BD Pigeon Hub is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Platform will be uninterrupted, error-free, or secure at all times.
• Any listing, pigeon, or seller is legitimate, as described, or of merchantable quality.
• Any transaction conducted through the Platform will be completed successfully.

Use of the Platform and any transactions entered into through it are entirely at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, AlphaCue Technologies and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of money, profit, or goodwill arising from any transaction on the Platform.
• Loss of data or content.
• Harm resulting from reliance on any user-generated content.
• Unauthorised access to or alteration of your account.

Our total liability to you for any claim arising from use of the Platform shall not exceed BDT 5,000 or the amount you paid to us in the preceding 12 months, whichever is less. BD Pigeon Hub is currently a free platform — no subscription fees are charged.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect by posting a notice on the Platform and, where possible, via email. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
